Set out below are the terms and conditions on which Wall Street Laser LLC (“Wall Street Laser”, “us”, “our” or “we”, as the context may require) provides laser hair removal services (“Services”) to its clients. The following constitutes a legal agreement between a buyer (“you”) and us with respect to our Services, the terms of which are set out below. By signing below, you represent that (i) you have read, understood and agree to be bound by these Terms and Conditions, (ii) the information provided by you in the “Skin Rejuvenation/Hair Removal Consent Form” is true and correct in all respects, (iii) you have followed and will continue to follow the pre/post care recommendations provided by us in writing or otherwise, and (iv) if you are or become concerned of the effects you may have as a result of the Services, you have discussed or will discuss the matter with your doctor or personal skin care adviser.

Age Policy

You hereby acknowledge you are (i) at least 18 years of age or (ii) the parent or legal guardian of the person receiving the Services, who is at least 14 years of age (the “Minor”). In the case of item (ii) above, you hereby consent the rendering of the Services on the Minor and acknowledge the risks of the same, including but not limited to those directly or indirectly to hormonal changes.

Payments and refunds

All payments shall be made upfront. You hereby acknowledge and accept that any deposit or payment made is strictly non-refundable. You understand a treatment may vary from person to person, thus, Wall Street Laser does not warranty or guarantee, expressed or implied, as to the results you may get or the amount of sessions required for complete hair removal. You understand treatments paid for but not completed, will expire exactly 24 months after the date of the last treatment undertaken. Notwithstanding the above if on the occasion you are offered a refund as a gesture of goodwill, this will be made on the understanding it is without any recourse and your acceptance of reimbursement on these terms.

Cancellation and Rescheduling

Wall Street Laser has a 24-hour cancellation policy. Should you need to cancel or reschedule an appointment, you shall give us 24 hour notice. You will be deemed to have forfeited the booked session and the Services that were to be provided therein if you (i) fail to show up for a scheduled appointment (no show), (ii) fail to cancel or reschedule an appointment at least 24 hours prior to the same, or (iii) if the laser technician finds you, in its sole discretion, unsuitable to receive the relevant treatment due to, including but not limited to, tanned skin, failure to properly shave prior to the appointment, or otherwise failure to follow the relevant pre-care instructions.

You are responsible for constantly providing details on the progress of hair removal to the laser technician for a better assessment of your procedure, and shall book appointments on a timely manner, based on the laser technician’s advice, to ensure better results.

Late arrival or failure to follow the guidelines for preparation of the treatment may result in reduced treatment time or forfeiting of the appointment. Wall Street Laser will endeavor to ensure that your appointment runs to time; however, should we need to cancel or postpone your appointment at short notice, we will make every effort to contact you in advance as soon as possible. Wall Street Laser will also endeavor to confirm your appointment one day prior to the scheduled date, however, you understand failure to confirm such appointment by us does not imply the cancellation of the same, thus, the no-show policy set forth above shall apply.

Treatments expire 24 months after your last attended treatment. When booking a treatment appointment, you must inform us if it has been 6 months or more since your last treatment appointment. If 6 months has lapsed since your last treatment you will be asked to fill in a fresh medical history form.

Free consultation

The first consultation booking is free of charge. The laser technician may, in its sole discretion, refuse to render Services to a client due to the risk of side effects, possibility of marginal or no improvement, or the client’s unrealistic expectations.

Liability

It your responsibility to provide Wall Street Laser with all relevant medical details prior to each treatment. Wall Street Laser shall have no liability to you for damages of any kind, including direct or indirect, special, punitive, incidental or consequential damages, costs, losses or expenses (whether in tort, contract or otherwise and whether at law or in equity) arising out of, or in connection with, the provision of any Services, unless Wall Street Laser acted with gross negligence or willful misconduct as found in a final, non-appealable judgment by a court of competent jurisdiction.

You hereby agree to comply with all instructions and/or recommendations given by, or on behalf of, Wall Street Laser regarding the home-care of a treated area. Wall Street Laser shall not be liable for any damages or side effects arising from your failure to follow such instructions and recommendations.

Indemnity

You agree to indemnify and hold harmless us, our shareholders, employees, laser technicians and consultants from and against any and all claims, losses, demands, causes of action and judgments (including solicitors’ or attorneys’ fees and court costs) arising from or concerning any breach by you of these Terms and Conditions and you agree to reimburse us on demand for any losses, costs or expenses we incur as a result thereof.

Gift cards

Gift cards may be exchanged for treatments of a higher price than the face value of the card, on payment of the difference. If any product purchased with the gift cards is lower in price than the gift cards, no change will be given and such amount shall be credited for future purchases. The purchase of gift cards is excluded from any offers.

Gift cards purchased are valid for 12 months from the date of purchase. At expiry the value will be lost. Gift cards presented after their expiry date will be treated as void and are non-exchangeable and non-refundable.

Gift cards cannot be returned or refunded, except in accordance with your legal rights.

Special offers and promotions

Discount codes or promotions cannot be used in conjunction with any other promotion.

Our right to vary these terms & conditions

We have the right to revise and amend these Terms and Conditions from time to time, for example, to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities. You will be subject to the policies and Terms and Conditions posted on the Site at the time that you have treatments or receive any Service from us.

Personal Data

You agree that it is your responsibility to provide accurate personal information (“Personal Data”) and to update your Personal Data as necessary to keep it accurate. You undertake that all the details you provide to us for the purpose of providing the Services to you are correct.

Assignment

You may not assign these Terms and Conditions and you may not transfer any purchased packages, sessions, credited amounts, gift cards or promotions.

We may assign our rights under these Terms and Conditions in whole or in part.

General

We have the right to change our prices without notice to you and you agree that we will not be responsible for any loss, damage or cost as a result of such changes.

Our liability, if any, for losses you suffer as a result of us breaking these Terms and Conditions is strictly limited to the price of any Services you purchased.

We shall not be responsible to you for damages or otherwise in respect of any error made to any listing of or reference to Services.

Disclaimers

You hereby acknowledge and agree that all treatment procedures carry some level of risk, and results and side effects may vary from person to person. Therefore, the results can not be guaranteed. You hereby represent that you are fully aware of and understand the potential risk and side effects of the treatments and include but are not exclusive of: pain, allergic reactions, skin sensitivity, skin irritation, skin breakout, erythema, redness and hyperpigmentation. In addition, the occurrence of such side effects is highly likely in the event of sun exposure, use of unsuitable skin care products, incorrect home-care, poor personal hygiene, tattoos and/or other possible unknown reasons. You will be advised during the course of the treatments to follow the before and after home-care instructions given. By signing below, you understand there is a possibility that you may have an adverse reaction or side effect from any one of the treatments during the course of the treatments and you hereby agree to immediately inform us of any adverse reaction or side effect you may have from time to time in order for us to take any measures we deem necessary. Therefore, the laser technicians reserve the right to discontinue treatment at any time if you are found to be unsuitable for treatment at any time, in their professional opinion.

Wall Street Laser maintains the Site to provide general information about the Services. The information on the Site should not be construed as specific medical advice or recommendation. Wall Street Laser does not guarantee that the information contained on the Site is accurate or complete and do not endorse opinions that may be presented on it. The information is subject to change from time to time without notice. Wall Street Laser is not responsible for any actions resulting from the use of this information either by professionals or other persons. Information contained on the Site is not a substitute for a consultation and physical examination by a trained professional. Only discussion of your individual needs with one of our staff will determine the best method of treatment for you.

The photographs and testimonials on the Site are not intended to represent the results that every client can expect. Due to many different factors results can vary greatly from client to client and as such results are individual and therefore cannot be guaranteed.

Third party rights

These Terms and Conditions is only for the benefit of you and us and no other person can claim a benefit from these Terms and Conditions.

Law and legal notices

These Terms and Conditions and any other terms or documents referred to herein represent your agreement with us with respect to the Services. If any part of these Terms and Conditions is held invalid or unenforceable, that portion shall be construed in a manner consistent with the applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. New York Law governs these Terms and Conditions and the Services, and you expressly agree that the New York courts shall have exclusive jurisdiction over any claim or dispute between us or relating in any way to these Terms and Conditions or the rendering of any Services.
